These Terms and Conditions ('Terms') govern your access to and use of the Stacket website and warehouse management platform (together, the 'Service'), provided by Stacket ('Stacket', 'we', 'us', or 'our'). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Using the Service
You must be authorized to act on behalf of your organization to create an account or use the Service. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
2. Acceptable Use
- Not to use the Service for any unlawful purpose or in violation of any applicable regulations.
- Not to attempt to gain unauthorized access to the Service, other accounts, or related systems.
- Not to interfere with or disrupt the integrity or performance of the Service.
- Not to reverse engineer, copy, or resell the Service except as expressly permitted in a separate written agreement.
3. Subscriptions and Fees
Access to certain features of the Service may require a paid subscription. Pricing, billing terms, and plan details are as agreed in your order form, invoice, or as published on our pricing page. Fees are non-refundable except as required by law or as otherwise stated in a separate agreement between you and Stacket.
4. Your Data
You retain ownership of the data you submit to the Service, including inventory, order, and warehouse activity records ("Customer Data"). You grant Stacket a limited license to host, process, and display Customer Data solely to provide and improve the Service. Our handling of personal information is described in our Privacy Policy.
5. Intellectual Property
The Service, including its software, design, and content (excluding Customer Data), is owned by Stacket or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or fully secure.
7. Limitation of Liability
To the maximum extent permitted by law, Stacket will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Service.
8. Termination
We may suspend or terminate access to the Service if you violate these Terms or if required to comply with legal obligations. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
